This website is operated by ArtSight L.L.C-FZ ("ArtSight", "we", "us", "our"). Throughout the site, these terms refer to ArtSight L.L.C-FZ, a company registered in the Meydan Free Zone, Dubai, United Arab Emirates, Trade Licence No. 2650268.01. ArtSight offers this website, including all information, tools and services available from it, to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices set out here.
The United Arab Emirates is our country of domicile, and ArtSight controls this site from the UAE. By visiting our site or purchasing from us, you engage in our "Service" and agree to be bound by these Terms of Service, including the additional policies referenced here (Privacy Policy, Returns & Refunds Policy, Shipping & Delivery Policy). Please read them carefully. If you do not agree, you may not use the website or our services. Our store is hosted on Shopify Inc., which provides the e-commerce platform that allows us to sell our products to you.
1. Online store terms
By agreeing to these Terms, you represent that you are at least 18 years of age. Minors under the age of 18 may not register as users of this website, transact on it, or otherwise use it. You may not use our products for any unlawful purpose, nor violate any laws in your jurisdiction (including copyright laws), nor transmit any malicious code. Any breach of these Terms results in immediate termination of your access to the Service.
2. General conditions
We reserve the right to refuse service to anyone, for any lawful reason, at any time. You agree not to reproduce, duplicate, copy, resell or exploit any part of the Service without our express written permission. The headings used in these Terms are included for convenience only and do not limit or otherwise affect them.
3. Products, pricing and made-to-order fulfilment
- Every artwork is produced on demand (print-on-demand). Each order is manufactured specifically for you after purchase. Because no item is held in stock, orders are not eligible for change-of-mind returns or exchanges (see our Returns & Refunds Policy).
- We have made every effort to display the colours and detail of our prints accurately. We cannot guarantee that your device's display will render colours exactly; minor variation between screen and printed work is normal and is not a defect.
- All prices are displayed in UAE Dirhams (AED) and are inclusive of 5% UAE VAT. Shipping charges, where applicable, are shown separately at checkout before you complete your purchase; there are no hidden charges.
- Prices and product availability may change at any time without notice. Editions and quantities may be limited. We reserve the right to limit, refuse or cancel any order at our discretion, including suspected fraudulent orders or pricing errors, and to notify you using the contact details provided at checkout.
4. Payments
We accept payment by major debit and credit cards and the other payment methods displayed at checkout, processed securely through our payment providers via Shopify. All transactions are charged in AED; the price displayed at checkout is the price charged to your card and shown on your transaction receipt. All refunds are made to the original method of payment. Please retain a copy of your transaction records and of our policies.
5. Artworks and intellectual property
All photographs and artworks offered on ArtSight remain the intellectual property of the contributing artists. Artists grant ArtSight the right to reproduce, print, market and sell their work as fine art prints. When you purchase a print, you acquire the physical artwork only, you do not acquire any copyright, reproduction right or licence in the underlying image. You may not copy, reproduce, scan, resell commercially, or create derivative works from any artwork purchased.
6. Charitable contribution
ArtSight is a commercial company. For every sale, 20% of the product price, excluding VAT and shipping charges, is donated by ArtSight, from its own revenue, to the Noor Dubai Foundation to fund sight-restoring surgery campaigns. ArtSight is not a charity, a fundraising organisation, or an agent collecting donations on behalf of any third party. The contribution is built into the product price; customers are purchasing an artwork, not making a separate donation. Donation figures and impact statements are provided in good faith and may be aggregated for reporting. When an order is refunded, the associated contribution is adjusted accordingly.
7. Certificate of Authenticity
Each artwork is supplied with a Certificate of Authenticity confirming its origin and the artist's authorship.
8. Accuracy of billing and account information
You agree to provide current, complete and accurate purchase and account information for all orders, and to keep it updated so that we can complete your transactions and contact you when needed. If you create a customer account, you are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. We reserve the right to limit or cancel orders that appear to be placed by resellers or distributors.
9. Sanctions compliance
We do not trade with or provide any services to individuals or entities that are subject to sanctions imposed by the United Arab Emirates, the United Nations, or other applicable sanctions regimes (including OFAC-designated persons and entities), or that are owned or controlled by, or acting on behalf of, such persons or sanctioned countries.
10. Third-party tools and links
We may provide access to third-party tools and links (including our payment, fulfilment and analytics providers) which we neither control nor monitor. They are provided "as is" without warranties. We are not responsible for the content, accuracy or practices of any third-party site or service; please review their terms before engaging with them.
11. User submissions
Any feedback, suggestions or ideas about our Service that you choose to send us may be used by us to improve our Service without restriction or compensation, and we are under no obligation to keep them confidential. This section does not apply to artworks or photographs: any use of an artist's work is governed exclusively by the separate artist agreement between ArtSight and the artist. You are responsible for ensuring your submissions are lawful and do not infringe the rights of any third party.
12. Personal information
Your submission of personal information through the store is governed by our Privacy Policy.
13. Errors, inaccuracies and omissions
Occasionally information on our site may contain typographical errors, inaccuracies or omissions relating to descriptions, pricing, promotions, shipping charges, transit times or availability. We reserve the right to correct any errors and to change or update information, or cancel orders, if any information is inaccurate at any time without prior notice (including after you have submitted your order). If we cancel an order for this reason after payment has been taken, we will notify you and issue a full refund to your original payment method within 14 business days.
14. Prohibited uses
You are prohibited from using the site or its content for any unlawful purpose; to infringe our or others' intellectual property; to harass, abuse or discriminate; to submit false information; to upload malicious code; to collect others' personal data; to spam or scrape; or to interfere with the security of the Service. We may terminate your use of the Service for violating any prohibited use.
15. Disclaimer of warranties; limitation of liability
We do not guarantee that your use of our Service will be uninterrupted, secure or error-free. The Service and all products are provided "as is" and "as available" without warranties of any kind except as expressly stated. To the maximum extent permitted by law, ArtSight L.L.C-FZ, its directors, employees, agents, suppliers and service providers shall not be liable for any indirect, incidental, punitive, special or consequential damages arising from your use of the Service or any product. Nothing in these Terms limits any rights you may have under mandatory UAE consumer law. Our total liability shall not exceed the amount paid for the order concerned.
16. Force majeure
We are not liable for any delay or failure to perform our obligations where this is caused by events beyond our reasonable control. Because production, fulfilment and delivery are carried out through third-party partners and international carriers, such events include (without limitation) acts of God, natural disasters, epidemics or pandemics, war, civil unrest, government action, border or customs closures, strikes, failures or interruptions of production, logistics, telecommunications or payment infrastructure, and any disruption affecting our suppliers or carriers. Where such an event occurs, delivery timeframes are suspended for its duration; if performance remains prevented for a prolonged period, either party may cancel the affected order and we will issue a full refund.
17. Indemnification
You agree to indemnify and hold harmless ArtSight L.L.C-FZ and its affiliates, officers, agents and service providers from any claim or demand, including reasonable legal fees, arising out of your breach of these Terms or your violation of any law or third-party right.
18. Severability, termination and entire agreement
If any provision of these Terms is found unlawful or unenforceable, it shall be severed without affecting the remaining provisions. These Terms are effective until terminated by either party; obligations and liabilities incurred before termination survive it. Together with the policies posted on this site, they constitute the entire agreement between you and us. Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
19. Governing law
These Terms of Service, and any separate agreements by which we provide you services, are governed by and construed in accordance with the laws of the United Arab Emirates and the applicable regulations of the Emirate of Dubai, and any dispute shall be subject to the exclusive jurisdiction of the Courts of Dubai, without prejudice to any mandatory consumer forum rights.
20. Complaints
If you are not satisfied with a product or with our service, contact us at info@artsight.org with your order number and a description of the issue. We aim to acknowledge every complaint and respond with a proposed resolution within 5 business days. If we are unable to resolve your complaint to your satisfaction, you may escalate it to the competent consumer protection authority in the relevant Emirate (in Dubai, the Department of Economy and Tourism / Consumer Protection).

You can review the most current version of these Terms at any time on this page. We reserve the right to update or replace any part of them by posting changes to our website. Material changes will be notified on this page with a revised effective date. Your continued use of the site after changes are posted constitutes acceptance of those changes.
