This Privacy Policy describes how ArtSight L.L.C-FZ ("ArtSight") collects, uses and shares your personal information when you visit or make a purchase on artsight.org. We process personal data in line with the UAE Personal Data Protection Law (Federal Decree-Law No. 45 of 2021) and applicable regulations.

1. Information we collect

  • Information you provide: name, email, phone, billing and shipping address, order details, and any message you send us.
  • Payment information: processed securely by our payment providers through Shopify. We do not store full card details.
  • Automatically collected: device, browser, IP address, and browsing activity, collected through cookies and similar technologies.
  • Artist applicants: if you apply to become a contributing artist, the portfolio, contact and payment details you submit.

2. How we use your information and our legal basis

We use personal information for the purposes below. For each purpose we rely on a lawful basis as required under the UAE Personal Data Protection Law:

  • Processing and fulfilling your orders (including production and shipping through our print and logistics partners), taking payment, and providing customer support — *basis: performance of our contract with you.*
  • Recording and reporting the charitable contribution associated with sales — *basis: performance of our contract and compliance with our legal obligations.*
  • Keeping accounting, tax and VAT records, and issuing invoices — *basis: compliance with our legal obligations.*
  • Detecting and preventing fraud and securing the platform — *basis: our legitimate interests in protecting our business and customers.*
  • Sending marketing communications and using non-essential cookies — *basis: your consent, which you may withdraw at any time.*

3. Who we share it with

We share personal information only as needed to operate the service, including with: our e-commerce platform (Shopify); our print-on-demand and fulfilment partners and the carriers who deliver your order; our payment processors; our accounting and tax tools; and, where required, regulatory authorities. Aggregate (non-personal) donation and impact figures may be shared with our charitable partner for reporting; we do not share your personal details with the Foundation unless you have asked us to.

If ArtSight is acquired by or merged with another company, or its assets are transferred, your personal information may be transferred to the new owner so that we can continue to provide our services to you, subject to this policy's protections.

4. International transfers

Because we rely on service providers and infrastructure located outside the UAE (including our e-commerce, fulfilment, accounting and automation tools), your information may be transferred to and processed in other countries. Where we do so, we rely on appropriate safeguards permitted under UAE law — including contractual protections with our service providers (such as standard contractual clauses), transfers to jurisdictions recognised as providing an adequate level of protection, or your explicit informed consent — to ensure your data continues to receive an adequate level of protection.

5. Cookies

We use cookies and similar technologies to operate the site, remember your preferences, analyze traffic and support marketing. Essential cookies are required for the site to function. Non-essential cookies (analytics and marketing) are set only with your consent, which you can give or withdraw through the cookie banner and your browser settings.

6. Data retention

We retain personal information for as long as needed to provide our services and to meet our legal obligations. In particular, records relating to orders, invoicing, tax and VAT are retained for a minimum of five (5) years as required by UAE tax law. Data no longer required is deleted or anonymised.

7. Your rights

Subject to UAE law, you may:

  • request access to the personal data we hold about you;
  • request correction of inaccurate or incomplete data;
  • request deletion of your data;
  • object to or restrict certain processing;
  • request a copy of the data you provided in a portable, machine-readable format (data portability);
  • withdraw consent to marketing or non-essential cookies at any time; and
  • lodge a complaint with the UAE Data Office if you believe your personal data has been processed in violation of the PDPL.

8. EU/EEA and UK residents

ArtSight currently sells and ships within the United Arab Emirates only, and this policy is written for UAE customers. If and when we begin offering products to customers in the European Union, EEA or United Kingdom, those customers will additionally benefit from the rights granted under the EU/UK General Data Protection Regulation (GDPR) — including access, rectification, erasure, restriction, portability, objection, and the right to lodge a complaint with their national data protection supervisory authority — and we will put in place the appropriate transfer safeguards and, if required, an EU representative under Article 27 GDPR at that time.

9. Security

We use appropriate technical and organizational measures to protect your information. No method of transmission or storage is completely secure, but we work to safeguard your data and to notify you and the relevant authorities of any breach as required by law.

10. Age of consent

Our site is not directed at children. By using this site, you represent that you are at least 18 years of age; minors under 18 may not register, transact or use the site, and we do not knowingly collect personal data from anyone under 18.
